Terms of Service

These Terms of Service ("Terms") govern your access to and use of YouGenOne (the "Service"), operated by [Owner Name], an Individual Entrepreneur registered in Georgia ("YouGenOne", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using YouGenOne, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. Description of Service

YouGenOne is a software-as-a-service platform that uses artificial intelligence to generate video content for YouTube and other platforms, including:

• Long-form videos (3–15 minutes) with AI-generated scenes, voiceover, subtitles, music, and thumbnails
• Short-form videos (vertical, ~50 seconds) optimized for YouTube Shorts, TikTok, and Reels
• Thumbnail generation with AI imagery and editable text
• Scene editing with the ability to regenerate individual scenes prior to final rendering

3. Account Registration & License Keys

Upon successful payment, we issue you a license key in the format PRO-XXXX-XXXX-XXXX bound to your email address. You are responsible for:

• Keeping your license key confidential
• Ensuring the email address provided is accurate
• All activity that occurs under your license key

License keys are non-transferable. Sharing or reselling keys is grounds for termination without refund.

4. Subscription Plans & Credits

The Service operates on a credit-based model. Plans include:

• Free — limited trial credits
• Starter — $49/month, 4,900 credits
• Creator — $99/month, 10,400 credits
• Studio — $199/month, 22,000 credits
• VIP — $399/month, custom desktop access via support

Credits are consumed when generating content. Pricing per generation depends on duration, AI model selected, and additional features (video scenes, music, multilingual translation). Unused credits roll over while your subscription is active. If a subscription expires, unused credits are forfeited unless renewed within the same billing cycle.

5. Payment Terms

Payments are processed through third-party providers (YooKassa, Heleket, and others as we add them). We do not store your full payment card information. By submitting payment, you authorize us to charge the listed price plus any applicable taxes.

You are responsible for any taxes, duties, or fees imposed by your jurisdiction.

We use real-time exchange rates from public sources (CBR, CoinGecko) to convert prices when necessary. Final price is displayed before checkout.

6. Ownership of Generated Content

You own the rights to videos, images, audio, and other content generated through your use of the Service ("Output"), subject to the following:

• You may use Output for commercial and non-commercial purposes
• YouGenOne retains no claim to your Output beyond what is required to deliver the Service
• You are solely responsible for ensuring your Output complies with applicable laws and platform policies (YouTube, TikTok, etc.)
• AI-generated content may not be eligible for copyright protection in some jurisdictions; you acknowledge this limitation

7. User Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws
• Not use the Service to generate prohibited content (see our Acceptable Use Policy)
• Not attempt to reverse-engineer, decompile, or interfere with the Service
• Not use automated systems to abuse credits, create multiple accounts to bypass limits, or otherwise circumvent the platform

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided on a best-effort basis. We may perform maintenance, deploy updates, or temporarily suspend features without prior notice. We are not liable for any losses arising from downtime.

9. Termination

We may suspend or terminate your access immediately, without refund, if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent activity, including chargebacks without prior contact
• Generate content that violates law in your jurisdiction or ours

You may stop using the Service at any time. Refund eligibility is governed by our Refund Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUT MAY CONTAIN ERRORS, INACCURACIES, OR UNEXPECTED RESULTS, AND YOU USE IT AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.

12. Indemnification

You agree to indemnify and hold harmless YouGenOne, its operator, and affiliates from any claims, damages, or expenses arising from your use of the Service, your Output, or your violation of these Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Georgia. Any dispute will be resolved in the competent courts of Tbilisi, Georgia, unless otherwise required by mandatory consumer protection laws of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the Service at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
